Every citizen has rights. That includes the right to a fair and speedy trial and, according to the 8th amendment, the right to bail. In the past, it was mainly used to ensure a defendant was not detained for long periods of time or charged bail amounts that were suited to the crime. Today, it allows the defendant to be released prior to their court date so they can return to work and continue to take care of their family and other responsibilities. It is a valuable tool that ensures each defendant is treated fairly and has every opportunity to hire an attorney and guarantee them a fair trial.

Commonly asked questions:

Q. What if my loved one is arrested in a different location other than were I live?
A. Bail by Phone is a feature we provide that offers added convenience and peace of mind. We use this feature so that anyone an use our service. It doesn't matter if you are a shut-in a few blocks from our office or a United States citizen on vacation in Europe, anyone can use our Bail by Phone feature. All you need is a valid credit card or access to a Western Union office and a copy/fax machine. We will fax or email you the paperwork. Fill it out, sign your name and fax it back to our office. Provide us with a valid credit card number or Western Union money transfer and we will get the ball rolling immediately.

Q. How much will it cost for me to post bail?
A. That depends. If you post the bond yourself, you will have to post 100% of the total amount. You will also have to go the jail in person and have cash on hand. If you use a bail bond agency, you will only have to pay a one-time premium of 10% of the total bail amount. If you have lived in your residence for at least a year and have steady employment, you may qualify for a zero down, low interest payment plan that will be easy on your budget and affordable in the long run.

If you choose to post bail on your own, you will be responsible for the entire bond amount. That means if the bail bond is $20,000. You will have to pay $20,000 in cash and in person. One of the drawbacks of doing things in this way, is that your money will be tied up for the entire length of the trial. You will not have access to your cash until the case is closed. After the case is ended, it can take up to three or four months to have your money exonerated or released by the court. Even then, you may not receive the entire amount in return. Most times, when cash is posted as a bail bond, the courts will deduct any court costs, attorney fees, fines and restitution before returning the money to the co-signer.

Q. How long does the process take before the defendant is released from jail after bonding out?
A. Completing the bail bond paperwork only takes about 30 minutes. The longest portion of the wait comes from the release process at the local jail. When a person is arrested and taken to jail, they are booked, photographed and fingerprinted. A background check is used to find any active warrants. Once the defendant is cleared and the bail bond amount set, the bail bonds agent can post bail and begin the release process. Depending on the size of the facility and how well staffed it is, the release process can take anywhere from 2 to 8 hours.
