Immigration Bonds are slightly different than local (or county) bail bonds. Immigration bonds require a 15% premium, and some form of collateral is generally required. However, they do serve the same purpose as to ensure the defendants appearance in court or by the INS (Immigration and Naturalization Service).
What to do if someone has an Immigration Hold
First thing, call our office1-305-968-0000. The immigration bail bonds process, unfortunately, not a quick one. We must let the local jail know as soon as possible that we are interested in posting bond on the local level. We do this because once bond is posted on the county level, ICE (Bureau of Immigration and Customs Enforcement) has a certain amount of time to extradite them to the immigration detention facility before they have to release defendant.
Immigration information we need about the defendant
- The Alien Registration Number
- The defendants date of birth
- Defendants country of origin
- The address and phone number where the defendant will be staying upon his/her release
- The name of the person requesting the immigration bail bond
- Amount of the Immigration Bonds
There are a few ways someone can have an immigration bond. Usually if someone is arrested for a crime, there will be a bond set locally that will have to be posted. One the local (or county) bond has been posted and there is a hold from ICE (Bureau of Immigration and Customs Enforcement ), the defendant will have to remain in custody until ICE comes to extradite the arrestee to a Immigration detention facility. Once at the Immigration Detention Facility, it could take a up to a three days for the defendant to be issued an immigration bond, if any at all. During this process, we can begin the Immigration bond process so that when the bail bond is set, we will be ready to post the immigration bond. A: The premium on Immigration Bonds is between 15% and 20%. In Florida, the premium is 15%
Q: How long does the Immigration release process take?
A: Once the bail is set, the defendant should be able to released that same day. However, further review of the bond may be required by the state attorney which may delay it a additional day.
Q: What kind of collateral is needed for immigration bonds?
A: Acceptable collateral is cash, real property, stocks and bonds. If you have other collateral in mind, please call our office and we will be happy to discuss other options.
Q: Is the 15% premium on the Immigration Bonds refundable?
A: No, no portion of the premium is refundable. The premium is our fee to post the full amount of the immigration bond at the jail.
Q: When is collateral returned?
A: All collateral will be returned once we receive a discharge notice from the court. No collateral will be returned until we get the proper documentation from the courts.
